House Bill 2612, if enacted, would make significant changes to the Liquor Code with respect to the way holders of restaurant and hotel liquor licenses may conduct business.
Currently holders of restaurant and hotel liquor licenses may conduct catered events only on their licensed premises. The designation of 'catered event' permits licensees to sell and/or serve an unlimited or indefinite amount of alcoholic beverages for a fixed price, provided that the event has been arranged at least twenty-four hours in advance. The catered event must be conducted for a third party and cannot be self-sponsored by the licensee.
House Bill 2612 would enable the holders of restaurant and hotel liquor licenses to conduct catered events off the licensed premises and on an otherwise unlicensed premises. This change would permit a restaurant and hotel liquor licensee to temporarily transfer its license to an unlicensed venue to hold a catered event.
The proposed legislation would also permit restaurant and hotel liquor licensees to sell up to two bottles of wine for consumption off the licensed premises so long as the bottles of wine remain sealed. Currently, only malt and brewed beverages can be sold for "take- out" provided that the sale does not exceed 192 fluid ounces.
House Bill 2612 has been referred to the House Committee on Liquor Control for further action.
