Employers should beware of a new U.S. Supreme Court decision that makes it easier for employees to prove they have been fired for age discrimination. In cases where the termination decisions have resulted in a disparate affect on employees over the age of 40, this decision places the burden on the employer to prove it terminated these employees because of reasonable factors other than age.
