Attorney John P. Muncer has over 35 years of legal experience in the areas of criminal law, family law, traffic defense, municipal law, labor law and civil litigation.
Attorney Muncer has spent over 20 years of his career as a prosecutor. In that capacity he prosecuted all types of criminal cases including Assaults, DUI’s, Drug Offenses, Property offenses, Sex crimes among all the major crimes, including over 20 Homicide cases and nine death penalty cases. He handled these cases from the investigation stage through the preliminary hearing stage, to guilty plea, trial, sentencing and on appeal. His vast experience as a prosecutor is an invaluable asset to those who are charged with a crime and are looking for a strong, vigorous defense by a seasoned criminal attorney. As a former prosecutor, Attorney Muncer has unique insight into what to look for in a given case to find and exploit its weaknesses. He knows the tactics and strategies prosecutors employ against defendants because he employed them himself for over 20 years. Also, as a well-regarded former prosecutor, he is in a good position to negotiate and obtain favorable plea agreements for his clients.
During the course of his career as a prosecutor, Attorney Muncer prosecuted over 100 criminal jury trials. Some noteworthy cases included the prosecution of multiple defendants on multiple charges arising out of the Coal Township Prison Riot. Two noteworthy Homicide cases involved minor children as victims. In the one case, the death penalty was sought and the jury returned a death sentence.
In addition to carrying a full adult criminal caseload, Attorney Muncer also handled all of the Juvenile Court matters, including Dependency and Delinquency cases, for his office and developed the experience and skills necessary to defend minors facing criminal charges and parents accused of child abuse or neglect.
In addition to his prosecutorial duties, John also maintained a private law practice and law partnership which had an emphasis on Family Law and Civil Law. Much of Attorney Muncer’s private practice was devoted to divorce, custody and support matters, in which he handled every aspect of Family Law from highly litigious custody trials, complex divorces and support, alimony to equitable distribution matters and every type of matter or proceeding in between. Attorney Muncer has handled every type of contract case, payment dispute, civil or commercial dispute between individuals, families and businesses.
Attorney Muncer served for several years as Solicitor and Chief Clerk of Northumberland County. In that capacity, Attorney Muncer developed a deep and extensive working knowledge of the Pennsylvania County Code and performed the following: reviewed and negotiated contracts with vendors and suppliers on behalf of the County Commissioners and most county departments including Children and Youth Services, Mental Health & Intellectually Disabled and Adult Services, provided legal advice to county & agency department heads on interpretation of laws, rules and regulations that arise in their respective areas of responsibilities, represented the county in all real estate tax assessments and appeals, represented the county and the county prison on employment-related matters, negotiated contracts between municipal and county government, negotiated contracts between labor unions and county departments and agencies, and reviewed and decided upon Right to Know Requests submitted requesting information about any county agency or department.
Any individual or business that has business before any Pennsylvania county or municipal government would do well to retain Attorney Muncer to represent them because of his extensive experience as a solicitor formerly representing county government.
Attorney Muncer also spent several years of his career as a Judicial Law Clerk. Part of his responsibilities in addition to attending all Court hearings was to consult with his Judge. He was responsible for researching legal issues for the Court and drafting all the Judges’ Opinions outlining the reasoning of the Court behind a given decision. In addition to his own handling of Family Law matters, the Judge for whom Attorney Muncer worked was the primary Family Court Judge and also the Judge assigned to Children and Youth cases in Northumberland County. This provided Attorney Muncer with yet more experience and knowledge of these fields of law and about how Judges consider cases and reach decisions.
Attorney Muncer spent almost his entire career and almost every day in the Courtroom. His Courtroom experience is almost unparalleled when compared to most attorneys who practice law. However, Attorney Muncer was not just a practitioner of the law; he was a teacher of the law as well. He spent fifteen years as an Adjunct Professor at Susquehanna University and a Lecturer at Luzerne County College teaching courses related to Criminal Law, Criminal Investigations, Constitutional Law. Many of his former students themselves became attorneys.
