Protect Yourself From Employment Discrimination

Pennsylvania and the federal government have laws that make most forms of employment discrimination unlawful and provide remedies for aggrieved employees. Under these laws, employees who believe they have been discriminated against must first allow the state (PA Human Relations Commission) and/or the federal (the EEOC, the Equal Employment Opportunity Commission) administrative agencies investigate their claims before filing a state or federal lawsuit against the employer.

While it might be natural for employees to want to first try to “work things out” with the employer, the state and federal anti-discrimination laws have very short limitations periods for filing a claim. Delay can therefore be fatal to your ability to vindicate your rights through a lawsuit against your employer. For this reason, if you believe you're being discriminated against on the basis of race, sex, age or disability, or being subjected to sexual harassment, it is imperative to have your claim evaluated by an experienced lawyer within the first couple months after such conduct occurs. If your employer retaliates against you for making such a claim, that retaliation is itself a violation of the anti-discrimination laws.
