Pennsylvania Lemon Law

Pennsylvania’s Automobile Lemon Law deals with the rights of consumers and the duties of manufacturers and dealers regarding the repair or replacement of new cars that have a defect or condition that substantially impair their use, value, or safety, and does not conform to the manufacturer’s warranty—technically referred to as a “nonconformity.” The purchaser of a defective vehicle has a civil right of action against a car manufacturer for damages, attorney’s fees, court costs, and other legal remedies.

Under Pennsylvania’s Automobile Lemon Law, a car manufacturer has the following duties with regard to defective new cars:

Duty to Repair: A manufacturer must provide free repairs to new cars with nonconformities that present within the earliest of:

  • one year after the car was delivered to you,
  • the first 12,000 miles of use, or
  • the expiration of the warranty term for the car

Duty to Refund or Replace: If the manufacturer cannot repair your car within a reasonable number of attempts, it must replace it with a comparable car of equal value or refund the full purchase price upon return.
